Heard Mr. Ram Pratap Yadav, learned counsel for the petitioner

and Mr. Dhirendra Singh, learned counsel for contesting

respondent.

On 2.12.2022, following order was passed by this Court:-

"Case called out as mentioned case.

Learned counsel for the petitioner is not present.

Learned counsel for the respondent is present and submitted that writ

petition was filed against the order passed by the Board of Revenue in the

pending revision. He further submitted that this Court while entertaining

the writ petition has granted interim order and directed the Board of

Revenue to take up the said revision and pass necessary order on the

admission as well as stay application.

He next submitted that the revision filed by contesting respondents has

been dismissed in default, as such, writ petition has become infructous."

List this case on 8.12.2022 at 2 p.m. in the additional cause list.

Learned counsel for the respondents shall inform about this order to the

counsel for the petitioner within three days."

In pursuance of the order dated 02.12.2022 the case is taken up

and learned counsel for the petitioner submits that the pending

revision before the Board of Revenue has been dismissed in

default, hence, the present writ petition has become infructious.

In view of the statement made by the counsel for the petitioner,

the writ petition is dismissed as infructous.

Interim order is vacated.
