Heard learned counsel for the applicant and learned A.G.A. for the

State.

This Application under Section 483 Cr.P.C. has been filed by the

applicant with a prayer to direct the court below to hear and decide

the complaint case no. 1243 of 2012, under Section 12 of

Protection of Women from Domestic Voilence Act, P.S.

Manduadih, District Varanasi pending before Judicial Magistrate-

II, Varanasi expeditiously within stipulated time.

Learned counsel for the applicant states that complainant/

applicant filed complaint case against her husband and family

members on the ground of being victim of domestic violence and

case is pending since August, 2019. The opposite party has put in

appearance. The application under section 23 of Domestic

Violence Act is also pending. No effective proceeding is being

taken in the court below, hence, a direction may be issued to the

court below
