1. Heard Sri Anand Dubey, the learned counsel for the

revisionist as well as Sri Shiv P. Shukla, the learned counsel for

the respondent-C.B.I. and perused the record.

2. By means of an instant revision filed under Sections 397 /401

Cr.P.C., the revisionist has challenged the order dated

17.04.2023 passed by the Special Judge, C.B.I. Court No.6,

Lucknow in Criminal Case No. 252 of 2017 under Section 120-

B read with 409, 420, 468, 471 I.P.C. and Section 13(1)(D) and

13(2) of Prevention of Corruption Act, 1988, P.S- C.B.I./A.C.B.

District Lucknow, whereby the revisionists application for his

discharged has been rejected by the trial court.

3.The aforesaid case has been registered on the basis of an F.I.R

No. RC0062014A0009 dated 21.02.2014, alleging the large

scale financial bungling, gross irregularities and

misappropriation of MGNREGA funds in District Gonda during

period 2008-0
