1. Heard learned counsel for the applicant as well

as learned A.G.A. for the State of U.P. and perused

the record.

2. The present bail application has been filed on

behalf of the applicant in Case Crime No.0173 of

2016 under Sections 395 I.P.C., Police Station

Cantt. District Ayodhya/Faizabad, with the prayer

to enlarge him on bail.

3. Learned counsel for the applicant submits that

the applicant is innocent person and has been

falsely implicated in the present case as he was on

bail in the present case and his counsel assured

him that he will inform him about the proceeding

of trial but due to fault of his counsel, he was not

appeared before the court below, therefore, non

bailable warrant was issued and applicant was
