1. Heard learned counsel for the applicant, learned A.G.A.

and perused the record. In view of order proposed to be

passed, issuance of notice to opposite party no.2 is dispensed

with.

2. The present application under Section 482 Cr.P.C. has been

filed with the prayer to quash the impugned summoning order

dated 14.9.2012 passed by the learned Special Chief Judicial

Magistrate CBI (A.P.), Lucknow in complaint no. 4227 of 2012

under Section 138 of the Negotiable Instrument Act as

contained in Annexure No. 1 to this petition as well as entire

proceedings of complaint no. 4227 of 2012 under Sections

under Section 138 of the Negotiable Instrument Act pending in

the court of Additional Judge Court No. 3, Lucknow.

3. Learned counsel for applicant has submitted that as per

complaint the cheques issued by the petitioner was dishonor
