1. Case called out in revised list. No one has put in appearance on behalf

of the petitioner to press this petition. However, learned counsel

representing side opposite is present in the Court.

2. Even on the first date of listing dated 31.5.2023, no one appeared on

behalf of the petitioner to press the petition and the following order was

passed on that date:

"Case called out. No one appeared on behalf of petitioner. However,

learned counsel for the side opposite are present.

In the interest of justice, the case is adjourned for a day.

List in the month of July, 2023, as fresh."

3. It appears that the petitioner and the counsel engaged by the petitioner

both have lost the interest in the case and are not interested in pursuing the

petition.

4. It would be appropriate to refer two maxims:-

(i) Vigilantibus non dormientibus jura subveniunt (The law assists only

those who are vigilant, and not those who sleep
