1. Supplementary affidavit filed on behalf of the applicant is

taken on record.

2. Heard Shri Satyendra Tiwari, learned counsel for the

accused/applicant as well as learned A.G.A. for the State and

perused the record.

3. This second bail application has been moved by the

accused/applicant- Mustafa @ Gulam Mustafa for grant of

bail, in Case Crime No. 24/2020, under Sections 147, 148, 149,

302, 34 and 120-B IPC, Police Station Krishna Nagar,

Lucknow, during trial.

4. Learned counsel for the accused-applicant while pressing the

bail application submits that the accused-applicant has falsely

been implicated in the instant case. The informant of this case

was not an eye witness and apart from this evidence which is

not material as he is not an eye witness, there is no substantial

evidence against the applicant.
