1. Heard Shri Mahendra Pratap Singh, learned counsel for the

petitioner, learned Standing Counsel for respondent no. 9 and

Shri Dilip Kumar Pandey, learned counsel for respondent no. 8.

2. On the first ground raised by learned counsel for the

petitioner challenging the impugned orders, which is to the

effect that in the application preferred by the private opposite

party for correction of revenue record the prayer was not sought

with regard to Gata No. 707, which belongs to the petitioner,

learned Standing Counsel for State-respondents submitted that

in view of law laid down by this Court in the judgment passed

on 12.07.2023 in Writ-C No. 3818 of 2023 (Ravindra Kumar

Vs. State Of U.P. Thru. Addl. Chief Secy. Revenue Deptt.,

Lucknow And Others), the Collector is under obligation to

correct the revenue record even without preferring an

application if the defect in the same comes to the notice of the

collector and taking note of the same, on query being put to

learned counsel for the petitioner as to whether the discrepancy

exists in the revenue records i.e. map and khatauni, he says that

he may be permitted to withdraw the instant petition with

liberty to file the same afresh with proper pleasings and

enclosing all the relevant documents.

3. In view of the above, the instant writ petition is dismissed as

not pressed with the liberty as prayed for.

4. The certified copy of the impugned orders or any other

certified documents filed along with the petition shall be

returned to the learned Counsel for the petitioner by retaining a

photocopy of the same on record.
