Heard learned counsel for the petitioner and

learned A.G.A. for the State.

This petition has been filed with the following main

prayer:-

"Issue a writ, order or direction in the nature of mandamus,

thereby commanding and directing the opposite parties no.2

and3 to secure/ protect the peaceful matrimonial life of the

petitioners, in the interest of justice."

Learned A.G.A. says, on the basis of instructions

sent by Sri Akhilesh Kumar Prajapati, Sub

Inspector, P.S. Deva, District Barabanki, that an

F.I.R. No.1036/2023 under Section 363 of the I.P.C.

has been lodged as the petitioner no.1 is a minor.

Accordingly, this writ petition is dismissed with

the liberty to the counsel for the petitioners to file

a fresh petition.
