THE HON’BLE PRESIDENT MR. JUSTICE H.N. SARMA AND THE HON’BLE MEMBER SHRI KAPA LIKHA & SMTI P.L. ETE 01/07/13 In terms of the order dated 01/06/2013, no reply has been submitted by the respondent. Mr. B. Sarma learned counsel appearing for the respondent has filed an application stating that respondent are intending to prefer appeal before the National Commission against the impugned order. But the period of limitation for filling appeal before the National Commission which is 30 days from the date of order as per Section 27 is expired long back. In such a situation we do not consider any alternate but to pass appropriate order for issuing warrant of arrest in terms of Section 27. At this stage Mr. Sarma obtaining instruction over phone from respondent has submitted that payment would be made in terms the judgement. But he requested for 45 days to make the payment. Considering the prayer made by Mr. Sarma we postpone the issuance of warrant against the General Manager, directing to make the payment within 15 days. Fixed on 26/07/13. MEMBER PRESIDENT MEMBER
