1. Being aggrieved and dissatisfied with the
judgment and order dated 30.09.2011 passed by
the Learned District Forum, Surat (addi) in
Complaint No.932 of 2008.
2. The appellant has preferred instant appeal on
the grounds that the impugned order is
arbitrary, perverse and is bad in law. The parties
will be referred to as per their original nomenclature
for the sake convenience.
3. The appellant side does not remain present since
long that’s why the latest reminder notice for
hearing was served on 17.08.2021 and notice
were served upon by registry it is on record.
4. On receiving the notice of this commission the
appellant Surat Municipality does not remain
present in the hearing nor any attempt for
adjournment of the appeal nor any kind of
application
before
me
that
about
the
adjournment of the appeal.
5. Looking to the facts and circumstances ld.
advocate Mr. D.M.Soni on behalf of respondent
nos.4 and 5 Mr. V.M.Pancholi on behalf of the
respondent Nos.1,2 and 3 are remain present
before me today matter cannot be heard on
merits because no one remain present on behalf

of the appellant side and that’s why looking to
the fact the matter is dismissed.

FINAL ORDER
i) Appeal No. 3311 of 2012 is dismissed.
ii) No order as to costs.
iii) Copy of the judgment be provided to the parties
free of charge.
iv) Registry is directed to send copy of this judgment
to the parties. Registry is directed to send a copy
this judgment to the District Commission Surat
(addi) through E-mail in PDF format for taking
necessary action.
