2. This appeal arises out of the order dated 10.8.2016 passed by the

District Consumer Disputes Redressal Commission, Barwani (for short the

‘District Commission’) in CC No.44/2013 whereby the District Commission

has dismissed the complaint filed by the appellant complainant on the

ground that the appellant had failed to establish that he had purchased the

battery in question and as such no question of deficiency in service for its

defect arises.

3. Having gone through the record and the impugned order, we find that

before the District Commission the appellant complainant had failed to file

any documents like cash memo or warranty card in respect of the battery in

question alleged
