This is an appeal filed U/s 27-A of the
Consumer Protection Act 1986 being aggrieved by
the order dated:21.10.2013 in E.P.No.28/2013 on
the file of Gulbarga, wherein the arrest warrant
came to be issued as against appellant/Judgment
Debtors.
2. Now the advocate for Judgment Debtor claims
that he has already paid the amount as per
Annexure-H and H1 and contends that the
impugned order required to be set-aside.
3. In this regard, we have heard the arguments
ofboth sides.
4. The point for consideration is only in respect
of whether the appellant/Judgment Debtor has
complied with the order passed by the District
Forum while executing the impugned order passed
in the complaint No.21/2013. If at all, the amount
has already paid by the appellant it is for the
appellant to place proper records before the District
Forum and by moving proper application in respect
of compliance of the order passed in
C.C.No.2 | l2Or dated: 18l04l2Or3

5. Now the appellant has placed reliance at
Annexure H and H 1 regarding compliance of the
order.
6. In view of the same it is for the Consumer
Forum to verify and to decide regarding compliance
of the orders passed in the complaint. With these
observation, the appeal requires to be a-llowed with
a direction to District Forum to recall the arrest
warrant as per the impugned order and to extend
an opportunity to the appellant/Judgment Debtor
in respect of the complialce of the main order in
the complaint and to pass needful order in this
regard.
