1. The appellant/original complainant has filed present appeal
under Section 41 of the Consumer Protection Act, 2019 against the
respondents/original opponents before the State Commission,
being aggrieved by and dissatisfied with the judgment and order
passed by the learned District Consumer Disputes Redressal
Commission, Amreli dated 16.4.2021 in complaint No. 158 of 2019.
The parties will be referred to as per their original nomenclature.
2. Heard ld. advocate Mr. D. N. Agoal for the appellant.
3. Ld. advocate for the appellant has filed the withdrawal pursis
which is taken on record wherein, it is stated as under:

“The appellant does not want to proceed further with the present
appeal due to technical reasons, therefore, he requested to grant
permission to withdraw the appeal.”
4. On perusing the Vakalatnama it is stated that “….તેમજ દાવાન ું
રાજીનામ આપવા કે પાછો ખેંચી લેવા , અમારા વતી દસ્તાવેજી પ રાવો રજ કરવા
અને પરત લેવા, આ રીતે તમામ અધિકાર આપ ું છું…..”
5. We have gone through the record of the case, verify the contents
of the withdrawn pursis. We have satisfied that a withdraw pursis
is genuine.
6. This Court has considered the reason stated in memo of appeal,
judgment and order passed by Ld. District Commission, contents of
withdrawn pursis and facts and circumstance of the case. In the
interest of justice following final order is passed.
O R D E R
I)
The Appeal No. 347 of 2021 is disposed of as withdrawn at the
stage of admission.
II)
No order as to costs.
III)
Copy of this order to be provided free of costs to the parties.
Registry is directed to send a copy this order to the District
Commission Amreli through E-mail in PDF format for taking
necessary action.
