MAHARASHTRA STATE,

CIRCUIT BENCH AT AURANGABAD.

First Appeal No. A/22/2020 to A/92/2020

BEFORE:

HON'BLE MS. S.T.BARNE PRESIDING MEMBER

HON’BLE MR. K.M.LAWANDE, MEMBER.

PRESENT:

Dated : 20/10/ 2021

ORDER

These appeals are filed on 09.01.2020. First date of admission of hearing was

on 31st Jan. 2020. Since filing of appeals Advocate for appellant never turned

up. Appellants are also not attending and the matters were adjourned for

hearing before admission from time to time. In spite of specific directions on

earlier date that if the appellants and their Advocate will not turned up,

necessary order will be passed in all the matters.

Perused the record. It reveals that, all the cases are based on Government

weather based crop insurance scheme. It reveals from record that, all the

cases are from Limbgaon Mahasul circle claiming compensation as not awarded

insurance amount as per norms. Wherein the respondent /original opponents

came with the defence that only trigger of continuous maximum weather about

39 degree Celsius is made out and therefore, compensation is awarded as per

Govt. circular dated 3.12.2015 which provide for continuous maximum weather

for six days at the rate of Rs.16,000/- per hector.

The District Consumer Forum has decided all the cases collectively and came to

the conclusion that already the amount awarded by opponent Insurance

Company at the rate of Rs.16,000/- per hector is just and proper. Hence,

pleased to dismiss the complaints claiming excess amount beyond the trigger

made out. And in some complaints No. CC/1146 to 1150 of 2018, CC/1092 of

2018 and CC/1120 of 2018 the complainant is directed to pay cost to the

opponent Bank to whom they made unnecessary party.

It seems that, appellants are not interested to proceed with the matters. In

spite of giving ample opportunity of hearing before admission appellants and

their Advocate not turned up even otherwise on perusal of record, and prima

facie reading there found no merits to admit the appeals. Hence, all the appeal

Nos. A/22/2020 to 92/2020 are hereby dismissed at the stage of admission.
