First Appeal No.344 of 2022
JUSTICE DAYA CHAUDHARY, PRESIDENT:-
The appellant i.e. Life Insurance Corporation of India
through its Senior Manager has approached this Commission by way
of filing the present appeal under Section 41 of the Consumer
Protection Act, 2019 (in short the ‘Act’) being aggrieved by the order
dated 08.03.2022 passed by the District Consumer Disputes
Redressal Commission, Moga (hereinafter referred as the “District
Commission”),
whereby
the
complaint
filed
by
respondent/complainant Sandeep Singla was allowed with the
directions to opposite parties No.1 and 2 to reimburse the
medical bills of the complainant amounting to Rs.2,07,340/-
alongwith interest @8% per annum from the date of filing of
complaint i.e. 08.07.2020 till its realization. The OPs No.1 and 2
were also directed to pay compensation of Rs.10,000/- to the
complainant jointly or severally for causing mental tension and
harassment. The compliance of the order was to be made within
a period of 45 days from the date of receipt of copy of order
failing which the complainant was at liberty to get the order
enforced through the indulgence of the District Commission.
2.
It would be apposite to mention that hereinafter the
parties will be referred, as have been arrayed before the District
Commission.
3.
Briefly, the facts of the case as made out in the complaint
filed before the District Commission are that the complainant

First Appeal No.344 of 2022
purchased the policy bearing No.133723854 from OP No.2 through
OP No.3 on 28.03.2015. The complainant remained admitted in
Dayanand Medical College and Hospital Ludhiana with effect from
02.08.2018 to 08.08.2018 and again from 16.08.2018 to 23.08.2018
and spent an amount of Rs.81,448.80 paisa and Rs.1,25,892/- on
account of medical charges in the said Hospital. The complainant had
informed the OPs after discharge. The complainant lodged his claim
for reimbursement with the OPs and completed all the formalities but
still it was lingered on one pretext or the other.
4.
Stating to be a case of ‘deficiency in service’ on the part
of the OPs and also the fact that the complainant has suffered mental
tension and harassment, the prayer in the complaint was made for
issuance of direction to the OPs to pay an amount of Rs.2,07,340/-
alongwith interest @12% per annum from the date of claim till its
realization and also to pay Rs.50,000/- as compensation for causing
mental tension and harassment as well
