Final Order / Judgement

Learned counsel Sri A.K.Samal is present on behalf of the complainant.

O.P No.1 entered appearance through Sri Rohini Kanta Pattnaik, Basanti Khadanga, and Sri S.K.Behera and filed V.nama. The V.nama be kept in record and their names be reflected in the cause list.

Sri S.K.Ghose appearing on behalf of O.P No.3 filed written version along with an petition for acceptance of the same and written notes of submission.

Heard the learned counsels appearing for both the parties.

Perused all documents, affidavits available in record. The Bank guarantee bearing No. 96/2007 dt.15-03-2007 for rupees 2,00,000/- was only for one years and the date of expiry was on 14-03-2008. We found there is no cause of action persists in this complaint petition, to proceed further apart from the fact the case of the complaint is a business to business transaction.

Hence the complaint case is dismissed.
