O R D E R :-

Learned counsel of opposite party No.2 has filed

Misc. application No.275/2022 under section 47(1)(a)(i) of the

Consumer Protection Act, 2019 read with Section 151 of Code

of Civil Procedure to decide the pecuniary jurisidction of the

Hon’ble Commission in the present complaint.

We have perused the application as well as the

consumer complaint.

Learned

counsel

appearing

on

behlaf

of

complainant has submitted that he has no objection, if the

present application is allowed and the consumer complaint is

ordered to be transferred to appropriate District Commission

for disposal in accordance with law.

In view of the submissions made by the learned

counsel of the parties and the prayer made in the application,

present consumer complaint is ordered to be transferred to

District Consumer Commission, Shimla for disposal in

accordance with law.

5.

Learned District Commission below on receiving

the copy of order is directed to issue fresh notices to the

parties, and thereafter, to proceed with the matter in

accordance with law.
