The learned Advocate Smt. Jayashri Kulkarni is present for the

applicant/appellant. Learned Advocate Shri. Gogawale is present for non-

applicant/respondent along with respondent Shri. Shrikant Shinde. As per

submissions made by learned advocate for the applicant/appellant, she has

not received any instructions from the applicant/appellant; therefore she has

sent ‘no instruction purshis’ to the applicant/appellant. On perusal of record,

it appears that last chance was granted to the applicant/appellant for hearing

on delay condonation application. It further appears that, since June 2021 for

six dates respondent is remaining present on each and every date and

applicant/appellant is seeking adjournments. Hence; application filed by the

applicant/appellant for condonation of delay stands rejected. Accordingly,

appeal does not survive for consideration. With this application for
