1. The present Complaint is filed under Section 21 (a)(1) of the Consumer Protection Act , 1986.
2. The Complaint is filed by Mr. Mahesh Parsana, Authorized Representative of the Complainant. The Complainant purchased a Standard Fire and Special Perils Policy from the Opposite Party for sum insured of Rs.1,50,00,000/- covering the risk of stock of raw material, semi-finished and finished goods used for automobile manufacturing, stock in trade, goods held in trust/commission. The Policy was valid from 21.08.2009 to 20.08.2010 and the Complainant paid premium of Rs.15,618/- and Rs.4,279/- for additional cover of burglary. The Complainant submitted that apart from the Policy Document, no other “Terms and Conditions” were provided by the Opposite Party.
3. On 19.05.2010 at about 10.44 am fire broke out in the factory premises engulfing the entire factory. The Complainant received a call from the neighbor about the fire and by the time he reached the factory, the entire unit was found to be burning. The Complainant submitted that it was normal to have power cut in the area on Wednesday and the unit was closed. Exact source of fire was, therefore, not known. The neighbors called the
