ORDER

1.      Heard Mr. R.K. Pandey, Advocate, for the complainants and Mr. Surendra Sheoran, Advocate, for the opposite party.

2.      Brij Kishore Gupta and Atul Kumar Gupta have filed above complaint for directing the opposite party to (i) handover possession of Apartment No. K-103, “Antriksh Golf View”, at Plot No.005-A, Sector-78, Noida; (ii) pay delay compensation @Rs.5/- per sq.ft. per month on the super area from 01.01.2013 till the date of handing over possession; or in alternative (iii) refund Rs.4887432/- with interest @18% per annum from the date of respective deposit till its realization; (iv) pay Rs.200000/-, as compensation for mental agony and harassment; (v) pay Rs.50000/- as litigation cost; and (vi) any other relief which is deemed fit and proper in the facts of the case.

3.      The complainants stated that the opposite party was company, registered under the Companies Act, 1956 and engaged in the business of development and construction of group housing project and selling its unit to the prospective buyers. The opposite party launched a group housing project, in the name of “Antriksh Golf View”, at Plot No.005-A, Sector-78, Noida, in the year 2010 and made wide p
