The present revision petition has been filed by the complainant for enhancement in the compensation amount granted by the Foras below. The District Forum while allowing the complaint had awarded a compensation of Rs.10,000/- and litigation expenses of Rs. 10,000/-. Thus, Rs. 20,000/- was given to the complainant. The complainant being dissatisfied with this amount of compensation filed an appeal before the State Commission. The State Commission vide impugned order dated 07.11.2014 dismissed the appeal and confirmed the order of the District Forum.
3. Ld. Counsel for the complainant submits that the compensation of Rs.10,000/- which had been awarded by the Fora below is insufficient compensation and it should be increased to Rs.25,000/-.
4. Ld. Counsel for the respondent submits that the present revision petition has no merits. It is submitted that the total claim of the complaint in his complaint was of Rs.6011/- and the Respondent has duly complied with the directions of the District Forum and paid the entire decretal amount including compensation and the litigation costs. It is submitted that the present revision petition is motivated by greed only.
5. I have heard the arguments and perused the record. The brief facts of the case are that the petitioner No. 2 had underwent some medical procedures for which she had incurred expenses of Rs.6011/-. When the claim was furnished to the Respondent, the Respondent had sanctioned only a sum of Rs.2978/- which was not accepted by the complainant and hence he filed the complaint.
6. The District Forum on merits allowed the complaint and issued directions for payment of amount of Rs.6011, as final settled amount of mediclaim along with litigation costs of Rs. 10,000/- and compensation for harassment of Rs. 10,000/-. In the present Revision Petition no reasonable grounds are shown as to how the order of the Fora below granting Rs.10,000/- towards compensation and Rs.10,000/- towards litigation costs, is perverse and unjustified as the claim of the complainant was only for Rs.6011/-. No evidence are there on record or brought to my notice which could suggest that the complainant had actually suffered a loss of Rs.25,000/-. Since the compensation awarded was towards mental agony etc., I am satisfied that the foras below have rightly assessed the amount of compensation to Rs. 10,000/- which is even more than the claim in the complaint. Besides that the litigation costs has also been awarded to the complainant by the District Forum. Respondent has also been directed by the District Forum to pay Rs.5,000/- in the Consumer Welfare Fund of State Commission. In the totality of the circumstances, I am satisfied that there is no merit in the present revision petition. The revision petition stands dismissed with no orders as to costs.
