REVISIION PETIITON FILED UNDER SECITON 17 (1) (B) OF THE CONSUMER PROTECTION ACT, 1986.
Oral Order :
The heard the points for consideration is whether the Revision Petitioner in maintable as order passed by District Consumer Forum in advisable learned counsel for petitioner at the time of admission and the following orders passed.
The revision petition is filed against the order passed by District Consumer Forum- III at Hyderabad IA No 140 of 2018 in CC No.59 of 2018
The Revision Petitioner herein are the Opposite parties in CC No.59 of 2018 and that they failed to file they written version consequently they were set expert and the Revision petition IA No. 140 of 2018 to set aside they expert order and permit them to file written version. The Opposite parties/Complainant opposed application and after herein both sides the District Consumer Forum dismiss the application as it has no power to set aside expert order.
The impugned order does not suffers any irregularity or illegality and does not require interference of the Commission, since the observation of the District Forum that the Forum does not have the power to set aside expert order is just and proper and the Commission also does not power to set aside order under revision unlike the National Commission. Hence revision petition is dismissed as not maintainable
However the petitioner may prefer an appeal challenge the original order passed by District Forum if so advised and petitioner may claim a benefit the Section 14 of the Limitation Act while preferring the appeal.
