This revision stems out of the order passed by the Forum below on 7.3.1998 in execution case no.82 of 1997.
The facts leading to this revision, in short, are that the respondent/complainant had filed a complaint no.328 of 1997 for payment of the 5 FDRs of Rs.10,000.00 each with maturity amount alongwith interest and compensation. Despite notice sent to the OP none appeared and therefore, the order was passed on 20.9.1997 as under:-
"फोरम आदेश करता है कि इस आदेश की प्राप्ति के 30 दिन के अंदर विपक्षी परिवादियों को उनकी परिपक्वता रकमें तथ उसपर परिपक्वता की तिथि से अदायगी की तिथि तक 15 प्रतिशत ब्याज अदा करे तथ 1500/- (पन्द्रह सौ रू0) हर्जाना एंव 400/- (चार सौ रू0) वाद व्यय रूपरूप अदा करेगा। विपक्षीगण परिवादियों का परिपक्वता रकमों को ब्याज सहित 5 चेकें तथा वाद ब्याज एंव हर्जाने की 1900/- (उन्नीस सौ रू0) की चेक दोनों परिवादियों के नाम संयुक्त रूप से फोरम में जमा करे। जहां से परिवादीगण उन्हें प्राप्त कर सकेंगे।"

As the order was not complied with hence, the complainant has filed the execution no.82 of 1997 and the ld. Forum passed the impugned order on 7.3.1998 which is as under:-
"इस विपक्षी को आदेशित किया जाता है कि वह इस आदेश की प्राप्ति के 15 दिन के अंदर जुर्माने की रकम 2000/- फोरम में जमा करे रकम अदा न करने पर एक माह के साधारण कारावास की सजा दी जाती है।"
None appeared to argue the case.
This revision has been filed on the ground that the Forum below has passed the order in complaint case no.328 of 1997 exparty. Thereafter, the Forum has in non-compliance of the aforesaid order passed in the complaint case, passed the impugned order issuing warrant of arrest against the revisionist. It is alleged by the revisionist that no show cause notice was issued to him. Besides, the revisionist has got nothing to do with M/s Asia Pacific Investment Trust Ltd. Hence, the order passed against the revisionist should be set aside but it transpires that none is appearing from the side of the revisionist to argue the matter. Besides, the impugned order passed on 7.3.1998 has been passed as the order passed in the complaint case no.328 of 1997, has not been complied and it also appears from the impugned order dated 7.3.1998 that a notice was duly issued to the revisionist/OP but none turned up, therefore, after being satisfied that the order is not being complied with and the revisionist/OP was flouting the order, the ld. Forum has passed the impugned order which does not suffer from any irregularity or illegality. Therefore, this revision has no legs to stand and is liable to be dismissed.
ORDER
The revision is dismissed.
No order as to costs. Certified copy of the judgment be provided to the parties in accordance with rules.
