Respondent File No. F.15(204)RJ/RERA/C/2020 Present Shri Nihal Chand Goel, Hon’ble Chairman CA Himanshu Goyal and CA Praneti Agarwal, on behalf of the respondent Date of Order: 26.07.2021 ORDER In the present matter, a show cause notice was issued to the respondent on 26.02.2021 under section 59 read with section 3 of the Real Estate (Regulation and Development) Act, 2016 (hereinafter called ‘the Act’) for having advertised its project ‘Siddharth Residency’ situated at Jodhpur, without obtaining prior registration thereof. A reply has been filed on behalf of the respondent stating that one flat was sold in the project (to one Shri Sanjay Mehta) before 01.05.2017 and the project was complete in all respects as on 01.05.2017, the date of commencement of the Act. Because of the death of the project architect, they could not obtain a completion certificate in time. They have obtained a completion certificate on Page 1 of 2 Ove File No. F.15(204)/202122.05.2019 from an empanelled architect, Shri Gaurav Kumar Agarwal, but it is evident from the sale deed of the said one flat
