Mr. Amit Kumar Kedia, C.A., present on behalf of respondent through V.C. Date of Order: 29.04.2022 ORDER Heard either of party at length and perused the record of the case carefully. The factual matrix of the case is that a project “Coral Shubh Niwas” bearing registration No. RAJ/P/2017/461 being developed by the respondent. The aforesaid project is elapsed on 31.01.2019. Resporident promoter neither submitted a completion certificate of ye project within stipulated period nor applied for extension prior to A os expiry of validity of the registration certificate. Therefore, a notice Page 1 of 2 F.3(286)RJ/RERA/P/2017under section 8 & 61 of the Rajasthan Real Estate (Regulation and Development) Act, 2016 (hereinafter referred to as ‘the Act’) was issued against the promoter respondent to explain his status why a penalty upto an extent of 5% of the project cost be imposed against him and after ousting from site why the work may not be assigned to any other agency for completion of the project. It is observed that promoter sought extension for validity of registration and requisite informations were required by the Authority with regard to extension of validity on 04.02.2020. During the course of hearing, representative of the respondent assured that he will fulfill the legal requirements and deficiencies in the application, therefore, prayed for adjournment. In view of the Bench, adjournment in the case is not warranted, therefore, respondent-promoter is directed to appear before the registry office with requisite documents for seeking extension of the project. In case promoter does not submit aforesaid required documents and requisite fee within 30 days of the direction uploaded on Website of the Authority, a subsequent notice is to be iss d against the \ promoter for non-compliance of the directions.
