Advocate Samkit Jain present on behalf of Respondent Date of Order: 19.05.2023 ORDER Due to non filing of the QPR, a notice under section 11 read with 63 of the RERA Act, was issued against the Promoter- respondent with regard to the project ‘Sanctity’ bearing registration No: RAdJ/P/2019/980 and a direction vide order dated 09,06.2022 was issued for seeking an extension for the validity of the registration of the project within 30 days. In case of failure for filing such an application, a penalty up to tune of Rs.1.0 lakh was imposed. The Promoter neither applied for extension nor deposited Page 1 of 2 Suo Moto Vs. The Promoter appeared before the Authority on 06.04.2023 and subsequently on 13.04.2023 and for the extension an opportunity to comply with the direction issued by the Authority was granted on the earlier hearing and it was stated by the Promoter that all the pending QPRs mentioned in the notice dated 28.09.2021 are already uploaded but an extension according to the ported before the Authority. In view of the non-compliance of the direction, it is directed “that the Promoter shall apply for application for extension for the validity for registration of the project. The escrow bank account of the project is to be freezzed with immediate effect unless an application for extension for registration of the project is filed before the Authority in prescribed manner.
