CORAM :
HON’BLE MR. JUSTICE S.B. SINHA
HON’BLE MR. JUSTICE DEEPAK VERMA
For Petitioner(s) Mr. Rajiv K. Garg, Adv.
Mr. Vineet Garg, Adv.
Mr. Annam D.N. Rao, Adv.
For Respondent(s)
UPON hearing counsel the Court made the following
ORDER
It is stated by the learned counsel that the contention that the
petitioner had nothing to do with the offence in question was urged
before the High Court; but from a perusal of the order of the High Court
it does not appear that such a contention has been raised before it. As a
matter of fact, the High Court has noticed that the learned counsel
appearing on behalf of the appellants before it could not be able to
question the correctness of the well-reasoned judgment. We are,
therefore, not in a position to agree with the submission of the learned
counsel that any other or further contentions had been raised on behalf
of the appellants therein. It is well-known that this Court shall go by
the judges’ record and thus if any other or further contention has been
raised before the High Court which has not been considered by it, the
only remedy open to the petitioner is to approach the High Court itself.
The special leave petition is dismissed with the aforementioned
observations.
