Leave granted.

2. Heard counsel for the parties.

3. In the facts and circumstances of the case, we deem

it proper to allow the prayer made at the instance of

the petitioner (the estranged wife) for transfer of the

case from the Chennai Court to the Madhurai Court. We,

accordingly, direct that GWOP No. 194 of 2008 instituted

by the respondent/husband for the custody of the

children and presently pending before the Principal

Sessions Judge, Chengalpattu, shall be transferred to

the Family Court at Madhurai. Let the records of the

case be transferred without any undue delay.

4. We further direct that during the current summer

vacation, the respondent/husband shall have the

temporary custody of the children for a period of two

weeks from May 09, 2010 to May 22, 2010. The husband

shall take the children from their mother at Gandhi

Museum, Madhurai (the place mutually agreed to by the

parties) at 10.00 in the morning of May 09, 2010 and

shall return them back to the mother at the same place

at 10.00 in the morning of May 23, 2010.

5. The Civil Appeal as also the IA filed by the

respondent stand disposed of in the aforesaid terms.

6. Before parting with the records, we may observe

that the differences between the parties do not appear

to be intractable and those can be sorted out by making

a little sincere effort by both sides. The parties will

be well advised to appear before the Mediation Centre,

Madhurai and try to resolve their dispute, if not for

themselves, in the best interests of their children.
