O R D E R
A decree of eviction on the ground of sub-letting of
the suit premises by the petitioner in favour of his brother
was passed against the petitioner which he had challenged by
way of special leave petition before this Court. After
hearing learned counsel for the petitioner, the special leave
petition was dismissed but the time to vacate the premises was
extended till 31st March, 2012 subject to filing the usual
undertaking.
The petitioner has now filed this review petition on the
plea that the respondent-landlord had failed to

discharge the burden that the petitioner had sublet the suit
premises in favour of his brother.
We have considered the reasonings assigned in support
of his version. But we are clearly of the view that this is
merely a reiteration of the submissions which were urged at
the time of admission of the special leave petition but did
not find favour with the court. The same grounds cannot be
allowed to be urged by way of a review petition as it fails to
satisfy the conditions required for entertaining a review
petition.
Under the circumstance, this review petition is
dismissed.
