UPON hearing the counsel the Court made the following

O R D E R

The petitioner has been convicted for offence under Section

302 of the Indian Penal Code and sentenced to undergo life

imprisonment. His appeal is pending before the High Court of

Chhattisgarh. By the impugned order, the High Court has dismissed

the bail application of the petitioner on the ground that the case

is listed for final hearing. It appears that on that day, the

arguing counsel was not available.

We are informed that the petitioner is in custody from

20.01.2011. Since the appeal is already listed for final hearing,

we request the High Court to take up the appeal for final hearing

and dispose it of as expeditiously as possible and preferably
