It   is   submitted   that   Ms.   Nanita   Sharma,   Advocate   for   the

petitioner has on 13.07.2018 filed application for substitution to

bring   on   record   the   Legal   representatives   of   deceased   respondent

Nos. 14 and 15 which is barred by time by 2577 and 2464 days and

therefore   counsel   has   also   filed   applications   for   condonation   of

delay in filing substitution and setting aside and abatement.

The applications were listed on 28.11.2018 before the Hon’ble

Judge in Chamber when His Lordship was pleased to pass the following

order:­

“Respondent Nos. 14 and 15 are reported to

have died.

Issue   notice   to   the   proposed   Lrs.   Of

deceased   Respondent   Nos.   14   and   15   returnable

within six weeks. ”

  Accordingly show cause notice was issued to all the proposed

legal representatives of deceased respondent No. 14 and 15 i.e. 14/1

and 14/2 and 15/1 by registered AD post and as per tracking report

of India post “Refused’ remarks on behalf of all the proposed Legal

representatives   have   been   received   but   no   one   has     entered

appearance.

Service of notice is deemed to be complete on behalf of all the

proposed legal represententives in application for substitution.

The applications above mentioned was listed before the Hon’ble

Judge in Chamber.
