The matter abovementioned was listed before the Hon’ble Court on
17.01.2019 with an office report dated 15.01.2019 when the court was pleased to
pass the following order:
“An affidavit is to be filed by the respondentBank indicating
as to what is the amount due as on 06.06.2018 and further
indicating as to how much principal and interest due till date
together with other supporting documents within a period of one
week from today.
Rejoinder affidavit be filed within one week thereafter.
List the matter after two weeks.”
It is submitted that pusuant to above order Mr. Arun Agarwal, advocate has
on 23.01.2019 filed affidavit for an on behalf of respondents in terms of order dated
17.01.2019. The same being circulated herewith.
It is further submitted that pursuant to order dated 03.08.2018 counsel for the
petitioner has on 14.01.2019 filed an application for extension of time for depositing
the remaining amount (Rs. 3200000/) in this Registry with the permission of the
Hon’ble Court. The same has been registered as I.A. No. 7730/2019. The same has
been included in the paper books.
It is further submitted that both the respondents are represented through Mr.
Arun Aggarwal, Advocate but no counter affidavit has been filed so far.
Service is complete.
It is lastly submitted that Mr. Vivek Gupta, Counsel for the petitioner has on
29.01.2019 filed Rejoinder Afffidavit on behalf the petitioner. The same being
circulated herewith.
The matter alongwith application abovementioned is listed before the
Hon’ble Court with this office report.
