The Transfer Petition above mentioned was listed before the Hon'ble Court on

08.05.2019, when the Court was pleased to pass the following Order:­

“Issue notice. 

In the meantime, there shall be stay of further

proceedings in Matrimonial Suit No.1951/2018 titled

Sandip   Kumar   Haldar   v.   Manisha   Shivani,   pending

before the Court of Addl. District Judge, Barasat,

North 24 Parganas, West Bengal.” 

Accordingly, certified copy of the order dated 08.05.2019 was sent to concerned

Trial Court  on 29.05.2019.

It is submitted that counsel for the petitioner has filed a letter stating therein that

notice may be issued to sole respondent on 1^st address of West Bengal only and the Order’s

were taken from the Ld. Registrar J­VI, hence notice was issued to the 1^st address of the sole

Respondent through Registered A.D. post on 30­5­2019 and  same is undelivered with

postal remarks “not delivered addresee cannot be located.” and neither A.D card nor

unserved notice has been received back.

It is submitted that vide Ld.Registrar Court’s Order dated 5­7­2019 and 8­11­2019

counsel for the petitioner has neither taken fresh steps nor filed fresh particulars of sole

respondent hence fresh notice could not be issued so far.

AND the matter was lastly listed before the Ld.Registrar Court on 20­1­2020 when

the following order was passed:

 “Despite grant of last opportunity, Ld. counsel for  the 

petitioner has  not taken requisite steps and also failed

to 

furnish fresh particulars for effecting service upon

the Sole Respondent,  matter be  processed  for  listing 

before  the  Hon’ble  Judge  in  Chambers  for   further 

directions. Await 

orders. List thereafter.”

Service of show cause notice is not complete.

The default on the part of the counsel for the petitioner is reported to the Hon’ble

Judge in Chamber with office report.
