The  matter   alongwith   applications   above­mentioned  except  I.A.   No.

27816 of 2020 was listed before the Hon’ble Court  on 7^th  February, 2020 when the

Hon’ble Court was pleased to pass the following order :

    

" Mukul Rohatgi, Sr. Advocate appearing for

the petitioners would urge that the final decree

passed on 17.02.2018 is a nullity as it has been

passed despite an express order of the High Court

staying further proceedings. The respondents have

controverted this position.

Learned counsel for the petitioners seeks time

to file aformal application to bring on record

relevant facts to buttress the argument that the

final decree is a nullity and for appropriate

relief(s). Issue notice on the proposed application,

if filed within one week from today, returnable on

25.02.2020.

Dasti, in addition, is permitted.

The notice to clarify that the Special Leave

Petition may be finally disposed of at notice stage,

including after considering the additional new

grounds to be urged by the petitioners, as aforesaid.

The said application will be heard alongwith the

Special Leave Petition.

Learned counsel for the respondents submits that

they would additionally serve dasti notice on the

concerned respondents to ensure that the matter

proceeds on the next date of hearing for final

disposal. We permit them to do so.

It is submitted for the information of the Hon’ble Court that  M/S. Aura & Co.,

Advocate has on 12^th February, 2020 filed an application for bringing on record the 

relevant facts to the effect that the final decree dated 17.2.2018 is a nullity and for 

appropriate relief which has been registered and the same is being circulated for the 

kind perusal of the Hon’ble Court.

It is submitted that Returnable Show Cause Notice for 25.2.2020 was issued to

all the nine respondents in addition to dasti service. Counsel for the Petitioner has 

on 19^th February, 2020 filed affidavit of dasti service with proof on behalf of all the 

respondents

Service of notice is complete.

The   matter   alongwith   applications   above­mentioned   is   listed     before   the

Hon’ble Court with this office report.
