It is further submitted that as per tracking report,
notice issued earlier has been returned back to GPO, New
Delhi with postal remarks, “Addressee Left without
instruction” in respect of Respondent No. 2.
Service of notice in respect of respondent no. 2 is
not complete.

“Learned counsel appearing for the petitioner
has submitted that the arguing counsel has some
personal difficulty.
List the matter on 17th December, 2019.
Pleadings are to complete in the meantime.”
It is submitted that Ms. Pratibha Jain, Counsel for
the Respondent No. 1 has on 12.12.2019 filed counter
affidavit, alongwith annexures A1 & A2 and application for
exemption from filing official translation but the same is
defective for the following reasons:
1. Trial Court Order dt. 29.07.2011 annexed as annexure R2
in counter affidavit but she has filed application under
Order 9 Rule 13 before Distt. Judge, Gwalior.
As the matters are on board, copy of the same is being
circulated to the Hon’ble Court.
It is submitted that as per tracking report, notice
has been returned back to GPO, New Delhi with postal remarks,
“Addressee Left without instruction” in respect of Respondent
No. 2.
Service of notice in respect of respondent no. 2 is
not complete.
