“Issue notice.
In the meantime, there shall be stay
of further proceedings in Matrimonial Case
No.797 of 2019 titled as Gyanendra Mishra vs.
Smt. Neha Mishra pending before the court of
the Principal Judge, Family Court, Saharanpur
(U.P.)”
Accordingly, notice was issued to sole respondent through regd. A.D. Post on
22.10.2019
It is submitted that as per tracking report of postal authority notice has been
delivered to sole respondent on 08.11.2019 .
It is submitted that Mr. Gyanendra Mishra, Respondent has on 09.12.2019 filed an
application for permission to appear and argueinperson and the same has been registered
as Interlocutory Application No. 189436 of 2019 and was placed before Ld. Registrar ( J
IV) under Order IV Rule 1 Proviso (C), Supreme Court Rules, 2013 for interaction on
23.01.2020. The report of Ld. Registrar (JIV) is enclosed herewith for kind perusal of the
Hon’ble Court.
It is further submitted that notice of hearing for 03.03.2020 was issued to Mr.
Gyanendra Mishra, Respondentinperson through Registered A.D. Post on 04.02.2020 and
as per tracking report downloded from postal site notice of hearing has been delivered on
05.02.2020.
