The Transfer Petition above mentioned was listed before the Hon’ble Court on
17.10.2019, when the Court was pleased to pass the following Order :
“Issue notice.
There shall stay of further proceedings
in Case No.HMA/547/2019 titled as “Suraj
Valraj versus Runki Kumari” pending before
the Addl. Principal Judge, Family Court at
Gurugram, Haryana.”
Accordingly, Certified copy of Court’s order was sent to concerned Trial Court
on 09.11.2019 and as per postal tracking report, certified copy of Court’s Order has
been delivered on 18.11.2019. (Copy enclosed)
It is submitted that notice was issued to sole respondent at both the addresses
through Regd. A.D. Post on 09.12.2019.
It is further submitted that as per postal tracking report notice has been
delivered at 1st address of Sole Respondent on 14.12.2019 and not delivered on 2nd
address of sole respondent, returned to New Delhi GPO with postal remarks
“Insufficient Address Left without instruction.” (copy enclosed)
It is further submitted that unserved cover containing notice has been received
from second address of sole respondent with postal remarks “Addressee Left.”
It is also submitted that Mr. Devendra Singh, Advocate has on 08.01.2020
filed Vakalatnama and Memo of appearance on behalf of sole respondent but he has
not filed Counter Affidavit in view of Order XLI, Rule 3 of SCR, 2013 and has not
filed an application for extension of time in terms of Order V Rule (1) 22 of SCR,
2013.
Service of notice is complete.
The matter above mentioned is listed before the Ld. Registrar Court with this
Office Report.
