O R D E R

Mr. Mohd. Irshad Hanif, learned counsel appearing for the

petitioner, submits that the petitioner is undergoing life sentence

and has already undergone more than 16 years of actual sentence. It

is further submitted that during the entirety of his incarceration,

the petitioner was not released on parole at any juncture. Reliance

is placed on certain decisions of this Court which have ruled that

in order to maintain the connection with the family and relations,

the relief of parole may be granted to a convict and such right of

the convict is traceable to Article 21 of the Constitution of

India.

In this backdrop the relief of parole is sought.

In response to the notice issued by this Court, Mr. V.N.

Raghupathy, learned counsel appearing for the State of Karnataka,

has invited our attention to the communication dated 14.07.2022

which inter alia states that the petitioner is
