We have heard Mr. Atma Ram Nadkarni, learned ASG appearing for
the appellant-Union of India.
We do not find any reason to interfere with the impugned
judgment of the High Court in the facts of the present case.
Accordingly, we find no merit in the appeal and the same is
dismissed. However, the question of law raised is kept open.
