O R D E R

Heard.

The arbitral tribunal appointed to adjudicate upon the

disputes between the parties comprised Hon'ble Mr. Justice A.M.

Ahmadi and Hon'ble Mr. Justice V.N. Khare, Former Chief Justices

of India, with Hon'ble Mr. Justice M.H. Kania, Former Chief

Justice of India, as the Presiding Arbitrator. Justice Kania is

reported to have resigned for health reasons and subsequently

passed away. This has led to a vacancy which the parties now

seek to supply through the medium of this petition.

Learned counsel for the parties submit that this Court

could appoint one of the Former Chief Justices of this Court as

the Presiding Arbitrator in place of Former Chief Justice M.H.

Kania.

In the circumstances, therefore, we allow this petition and

appoint Dr. A.S. Anand, Former Chief Justice of this Court, as

Presiding Arbitrator with Former Chief Justices, A.M. Ahmadi and

V.N. Khare, as members of
