The writ petition filed in the year 2018 was dismissed by the
Division Bench of the High Court of Punjab and Haryana, for being
not satisfied with the cause stated towards an inordinate delay of
about three years in approaching the Court.
Seeking to question the said order of the High Court
22.11.2018, the present petition seeking leave to appeal has been
filed on 07.10.2021. The application seeking condonation of delay
mainly states the reason that the matter was under examination at
“various levels” and then, a few decisions of this Court are
referred to submit that certain amount of latitude is not
impermissible in regard to delay in litigation brought about by the
State.
The said decisions do not make out any case for condonation of
an inordinate delay in filing the present petition and that too
where a local body seeks to question the order passed by the
Additional Chief Secretary to the Government in its revisional
jurisdiction. No case for condonation of delay being made out, the
application being I.A. No. 146082 of 2021 is rejected.
Consequently, the petition stands dismissed on the ground of
delay.
