UPON hearing the counsel the Court made the following

O R D E R

By a judgment and order dated 01.10.2020 in Criminal Appeal

No. 648 of 2020 (Parvez Noordin Lokhandwalla vs. State of

Maharashtra & Anr.) passed by this court by a Bench presided over

by Hon’ble Dr. Justice Dhananjaya Y. Chandrachud, this Court

permitted the petitioner to travel to the US for a period of eight

weeks subject to the condition that he would furnish a undertaking

to this Court before the date of travel, that he would return to

India after the expiry of eight weeks and that he would be

available on all dates of hearing before the Court of jurisdiction

unless specifically exempted from personal appearance.

said order dated 01.10.2020 passed by this Court being MA No. 767

of 2021 in MA No. 2271 of 2020 in Criminal Appeal No. 648 of 2020,

whereupon, this Court passed an order dated 18.06.2021,

modification whereof has now been sought for.

The aforesaid order was passed by a Bench presided over by one

of us (Indira Banerjee, J.) in vacation when the regular courts

were not sitting. By the said order dated 18.06.2021 passed in

vacation, this Court, as a last chance, granted further time of six

months from 01.07.2021 to return to India and report to the

concerned Court. Now the petitioner seeks further extension of

time to return.

As the aforesaid order dated 18.06.2021 passed by this Court

in vacation, was in modification of the judgment and order dated

01.10.2020 passed by the Bench presided over by Hon’ble Dr. Justice

Dhananjaya Y. Chandrachud, propriety demands that this application

should be placed before the Bench presided over by Hon’ble Dr.

Justice Dhananjaya Y. Chandrachud.
