UPON hearing the counsel the Court made the following

O R D E R

We decline to interfere in this special leave

petition, as we find that the High Court has recorded finding

of fact that possession of the subject land had already been

taken on 16.07.2007.

In that view of the matter, the relief of lapsing of

acquisition proceedings cannot be countenanced in light of the

exposition of the Constitution Bench of this Court in Indore

Development Authority vs. Manoharlal & Ors. reported in (2020)

8 SCC 129.

Despite rejection of this petition, it will be open to the

petitioner to pursue remedy under Section 101-A of the Right to

Fair Compensation and Transparency in land Acquisition,

Rehabilitation and Resettlement Act, 2013, as applicable to the

State of Haryana. That be considered by the appropriate

authority expeditiously on its own merits and in accordance

with law keeping in mind the dictum in C.A. Nos. 2714-2715 of

2021 titled as "Raghubir Singh & Anr. Etc. vs. State of Haryana

Etc. and connected matters" decided on 15.07.2021.

The special leave petition is disposed of accordingly.

Pending applications, if any, stand disposed of.
