Having heard learned senior counsel for the

appellant and having perused the material placed on

record as also having gone through the cited decisions in

E.S. Krishnamurthy and Ors. v. Bharath Hi-Tecch Builders

Private Limited: (2022) 3 SCC 161 and Innoventive

Industries Limited v. ICICI Bank and Anr.: (2018) 1 SCC

407, which have been duly taken into consideration by the

National Company Law Appellate Tribunal, we are satisfied

that the view as taken by the Appellate Tribunal,

particularly with reference to the factual matrix of the

present case, is a just and proper view of the matter,

more particularly with reference to the latest view of

this Court as reflected in Vidarbha Industries Power

Limited v. Axis Bank Limited: (2022) 8 SCC 352.
