UPON hearing the counsel the Court made the following

O R D E R

We have heard Mr. Dhruv Mehta, learned Senior Advocate,

appearing for the petitioner and Mr. Neeraj Kishan Kaul, learned

Senior Advocate, appearing for the respondent. Having gone through

the impugned judgment and order passed by the High Court, we see no

reason to interfere with the same in exercise of powers under

Article 136 of the Constitution of India.

The Special Leave Petition is, accordingly, dismissed.

However, considering the fact that the dispute is of a

commercial nature, we direct the learned trial Court to finally

decide and dispose of the Suit at the earliest and, preferably,

within a period of 12 months from today. All concerned are

directed to cooperate the learned trial Court in expeditious

hearing of the Suit as stated herein above.

Pending application stands disposed of.
