O R D E R

1.

Learned counsel for the rival parties are agreed, that an

arbitrator be appointed, and since the venue of the arbitration is

Mumbai, preferably a retired Judge of this Court in Mumbai may be

appointed as arbitrator.

2.

Having heard learned counsel for the rival parties, in

consonance with their joint request, Mr.Justice (Retd.)H.L.Gokhale

is appointed as a sole arbitrator. The arbitrator shall enter

reference after complying the provisions of the Arbitration and

Conciliation Act, 1996, as amended.

3.

The instant Arbitration Case is allowed, in the above

terms.
