Secretary of High Court Legal Services Committee, Indore.

The response, as filed completely demolishes the

claim of the appellants that they were not represented

before the High Court as such. The record seems to

suggest otherwise. It is a different matter that the

appellants were not represented by advocate of their

choice.

Be that as it may, presently, we are considering the

prayer for bail. After taking into account all the

relevant facts, including that the appellants were

acquitted by the Trial Court vide judgment and order

dated 19.09.2001 which decision has been reversed by the

High Court only on 20.05.2020; and during this period,

the appellants were at large and no untoward fact has

been reported against them, we deem it appropriate to

direct immediate release of appellants (Beeramlal and

Hukum Singh) on bail, during the pendency of the present

appeal, to the satisfaction of the Additional Sessions

Judge, Biaora, District-Rajgarh, Madhya Pradesh in

connection with Sessions Trial No. 179 of 2000 and on

such terms and conditions as may be imposed by the Trial

Court. Ordered accordingly.

3

List this appeal in the second week of March, 2022

for hearing.
