Introduction

[1] This is an application by the Plaintiff for summary judgment to be entered against the 1st Defendant pursuant to O 14 r 1 of the Rules of 2012.

[2] The 1st Defendant opposed this application mainly on the ground that leave of the Court is required during the period of the interim judicial management of the 2nd Defendant.

Brief Factual Back Ground

Banking Facilities Granted To The 1st Defendant

[3] At the request of the 1st Defendant, the Plaintiff granted various Banking Facilities to the 1st Defendant ("Banking Facilities").

[4] By way of a letter of offer dated 26 September 2006 which was duly accepted by the 1st Defendant, the Plaintiff granted various Banking Facilities to the 1st Defendant in the total limit of RM10,000,000.00.

[5] The terms of the Banking Facilities were further renewed, reviewed and/or revised by, inter alia, the following documents:

a. Supplemental Letter of Offer dated 23 January 2007;

b. Supplemental Letter of Offer dated 2 April 2008;

c. Supplemental Letter of Offer dated 22 April 2008;

d. Letter of Offer dated 14 December 2011;

e. Supplemental Letter of Offer dated 22 December 2011;

f. Letter of Notification dated 13
