Introduction

[1] This is an Originating Summons ("OS") filed by the Plaintiff ("P") against the Defendant ("D") seeking for the following reliefs:

(a) A declaration that the financial statement dated 31 December 2021 (and subsequent years) to be rectified to reflect a sum of RM2,980,649.00 being owing to P's directors;

(b) A declaration that the rectified financial statement dated 31 December 2021 to be handed by D to the Companies Commission of Malaysia with any fee or penalty where applicable to be borne by D;

(c) A sum of RM816,237.65 to be paid forthwith by D to P;

(d) Interest on the judgment sum at 5% per annum from 26 October 2021 till the date of this court's order;

(e) Interest on RM816,237.65 at 5% per annum from the date of this court's order till full and final settlement;

(f) Costs; and

(g) Other reliefs deemed appropriate by this court.
